Financial assistance - general

The act of 16 December, 2004, effective as of 1 January, 2005, amending the act on the education system and personal income tax (Journal of Laws No. 281, item 2781) introduced "Chapter 8a" to the act on the education system, concerning financial assistance for students. The purpose of this assistance is to reduce differences in access to education, allow to overcome barriers that prevent students in a difficult financial situation from receiving education and support talented students.
 

It may also serve for motivational or social purposes. Motivational benefits granted as part of financial assistance include: scholarships for learning or sports achievements, scholarships of the Chairman of the Council of Ministers, scholarships of the minister competent for education, scholarships of the minister competent for culture and national heritage protection.

 

Scholarships for learning or sports achievements are granted by the headperson of the respective school, after consultations with their teaching staff, from funds allocated by the managing authority of the school for this purpose. A scholarship can be granted once per month and cannot be higher than PLN 128. A scholarship for learning achievements may be granted to a student who has achieved a high average mark in the period (semester) before the period (semester) to be covered by the scholarship, whereas a scholarship for sports achievements may be granted to a student who has achieved high results is sports competitions held at least at the inter-school level. Scholarships for learning achievements are not granted to pupils from grades 1 to 3 of primary school and students from the 4th grade of primary school during the first semester, whereas scholarships for sports achievements are not granted to pupils from grades 1 to 3 of primary school. A pupil cannot apply for a scholarship for learning or sports achievements before completing the first period (semester) in their respective school. Scholarships for learning or sports achievements are only granted upon a request. Such a request may only be filed by the from tutor of the respective class. Students attending colleges for teachers or social workers may file such requests themselves. The average mark being the criteria for granting a scholarship is determined by the scholarship committee, after consultations with the teaching staff and student council.

The provision of social benefits is the responsibility of the gmina. These benefits can have two forms: school grants or allowances.

Students entitled to receive school grants are those who live in Bialystok and are in a difficult financial situation due to a low income per family member, particularly when one of the following occurs in their family: unemployment, disability, a serious or long-lasting disease, multiple children, lack of upbringing or educational skills, alcoholism, drug addiction, as well as families that are incomplete or have been affected by a random event (art. 90d par.1 of the act of 7 September, 1991 on the education system). The monthly income per one member of the student's family that entitles for applying for a school grant may not be greater than the amount specified in art. 8 par. 1 item 2 of the act of 12 March, 2004 on social assistance (Journal of Laws No. 64, item 593 as amended), i.e., PLN 351.00 after tax.

The monthly income shall be determined by the rules defined in art. 8 par. 3 - 13 of the act of 12 March 2004 on social assistance (Journal of Laws from 2004, No. 64, item 593 as amended).

The income refers to the total monthly revenue gained in the month preceding the submission of the application or, in the event of a loss of income, the revenue gained in the month of submitting the application, regardless of its source or entitlement thereto, reduced by:

  1. the personal income tax;
  2. the health insurance premium defined in the regulations on the obligatory insurance in the National Health Fund and the social insurance premiums defined in separate regulations;
  3. the amount of alimony paid to third parties.

 

The income shall not include: one-time social cash benefits and any in-kind benefits.

The following persons are not entitled to school grants:

  1. students of public schools and non-public schools with a public accreditation that educate youth and adults and students of public teacher training colleges, teacher training colleges of foreign languages or colleges for social service workers - until the end of their education, however not longer than until they finish their 24th year of age;
  2. wards of public and non-public institutions that allow children and youth described in art. 16 par. 7 (of the act on the education system), including mentally impaired children and youth with multiple disabilities, to fulfil their schooling and learning obligations - until they complete this obligations;
  3. students of non-public schools without a public accreditation that educate youth and adults - until they complete their learning obligations;
  4. students of non-public teacher colleges and teacher colleges of foreign languages - until they complete their education, however not longer than until they finish their 24th year of age.

 

Students who receive other social grants from public funds are not entitled to receive school grants. An exception to this rule is a situation when a student who receives other social grant from public funds may receive a school grant, provided that the total annual amount of these grants does not exceed PLN 1,128.00 or, in the case of students of teacher colleges, teacher colleges of foreign languages and colleges for social service workers, PLN 1,152.00 (art. 90d par. 12 and 13 of the act of 7 September, 1991 on the education system).

Financial assistance in the form of social benefits may be granted upon a request from:

  1. parents or a mature student, after consultations with the headperson of the respective school, teacher college, teacher college of foreign languages, college for social service workers or institution allowing youth and children with serious mental retardations, including mentally retarded children and youth with multiple disabilities to complete their schooling and learning obligations;
  2. the headperson of the respective school, teacher college, teacher college of foreign languages, college for social service workers or institution allowing youth and children with serious mental retardations, including mentally retarded children and youth with multiple disabilities to complete their schooling and learning obligations;
  3. benefits may also be granted ex officio.

 

 

Monthly amounts granted to each students will vary from PLN 51.20 to PLN 128. Social grants may be provided in one or several forms:

  1. a total or partial coverage of the cost of participating in educational classes, including remedial classes not included in the curriculum, as well as educational classes provided outside of the school;
  2. a material aid of educational nature, including purchase of course books;
  3. a total or partial coverage of the cost of learning away from the town or city of residence (applies only to students of high schools and colleges);
  4. as a cash benefit in exceptional cases, if the authority providing the grant decides that providing it in one of the forms described in items 1 and 2 is not possible or futile - in item 4.

 

A school grant, depending on its form, may be disbursed on a monthly basis or as a one-time payment, however the total amount thereof in the respective school year may not exceed twenty times the amount mentioned in art. 6 par. 2 item 2 of the act of 28 November, 2003 on family benefits (Journal of Laws from 2003 No. 228, item 2255 as amended), which currently equals PLN 1,128, or eighteen times the amount mentioned in art. 6 par. 2 item 2 of the act of 28 November, 2003 on family benefits (Journal of Laws from 2003 No. 228, item 2255 as amended) in the case of the students of teacher colleges, colleges of foreign languages and colleges for social service workers, which currently equals PLN 1,152.

A school granted may be awarded for a period not longer than from August to June in a given school year or, in the case of the students of teacher colleges, teacher colleges of foreign languages and colleges for social service workers, for a period not longer than from October to June in a given school year.

Another form of social financial assistance is a school allowance. It may be awarded to a student who is temporarily going through a difficult financial situation caused by a random event.
A school allowance may be provided in the form of a cash benefit for covering expenses related to education or as a material aid of an educational nature, once or several times in a year, depending on the school grant received by the student in question.
The amount of a school allowance disbursed at a time may not exceed five times the amount mentioned in art. 6 par. 2 item 2 of the act of 28 November, 2003 on family benefits (Journal of Laws from 2003, No. 228, item 2255 as amended), which currently equals PLN 320.
 

A school allowance may be applied for within no more than two months from the occurrence of the random event that justifies awarding this allowance.

 


  

Item 1206 of the Official Journal of the Podlaskie Voivodeship No. 102 of 2 May, 2005, contains the text of Resolution No. XXXVII/441/05 of the Bialystok City Council of 21 March, 2005, defining the rules of providing financial assistance of a social nature to students living in the City of Bialystok. The resolution entered into force on 17.05.2005 and became effective on 1 January, 2005.
